Terms of Service
1. Introduction
These Terms of Service (TOS) govern your access and use of www.youknow.ae (the "Platform" or “Service”) provided by [Youknow FZE] ("youknow"). By using the Platform, you agree to be bound by these TOS. If you do not agree to these TOS, you, nor any agent acting on your behalf may not use the Service. The Platform connects (“connection”) employers (“Clients”) to job seekers (“Candidates”) via referrals (“Referrals”) made by industry experts (“Referrers”).
2. Fee
The Employer shall pay the Platform a 10% fee within 7 days of the Candidate commencing their first day probationary employment. The fee is applied to the Candidate's Gross annual salary, including but not limited to basic salary, housing allowance, travel allowance (guaranteed package). If the Candidate is terminated from the initial or any other position within 90 days from the candidate's first day (“Probation Period” or other), then the Platform shall refund the fee, less processing charges. The fee shall not be refunded if the Candidate is terminated due to unlawful dismissal, redundancy, or a change of job description or job title.
A fee shall be paid by the employer to youknow from any Connection that results in any candidate being placed in any future position within 12 months of the introduction.
3. Commission
The Platform shall pay the Referrer a commission upon a successful placement of a Candidate. The commission is 50% of the fee after administrative deductions. It shall be paid after the candidate has passed probation or 90 days and when the platform has received payment from the client. If the Platform refunds the fee, neither the platform nor the referrer will receive a commission.
4. Non-Solicitation
Both the Employer and the Referrer agree not to circumvent the Platform for recruitment purposes. For a period of 12 months from the date of a Connection made through the Platform, the Employer or its agents and the Referrer or its agents shall not directly solicit, hire, or engage in any employment discussions with the Candidate introduced through the Platform without the involvement of the Platform.
5. Prior Permission
Referrers agree to obtain prior permission from the Candidate before making a Referral through the Platform. This includes ensuring that the Candidate is aware that Youknow may reach out to them based on the Referral. Referrers are responsible for confirming the Candidate's consent and complying with applicable data protection laws.
6. Intellectual Property
The Company owns all intellectual property rights in the Service, including its trademarks, copyrights, and trade secrets. You agree not to infringe on any of the Company's intellectual property rights by agreeing to these terms of service.
7. Acceptance of the Terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the Website and Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Website and Services.
8. Amendments
We reserve the right to modify this Agreement or its terms relating to the Platform and TOS at any time, effective upon posting an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.
9. Limitation of Liability
To the fullest extent permitted by law, the Company disclaims all liability for any damages arising out of or in connection with your use of the Service, including but not limited to direct, indirect, incidental, consequential, special, punitive, or exemplary damages.
10. Termination
The Platform may terminate your access to the Service at any time, for any reason, and without notice.
11. Content
You are solely responsible for the Content you post, upload, or transmit through the Service. You agree that you will not post, upload, or transmit any Content that is infringing, defamatory, obscene, threatening, harassing, abusive, hateful, or racially, ethnically, or otherwise discriminatory; exploits or harms children; violates the privacy or intellectual property rights of others; is unlawful or violates any applicable law or regulation. The Company reserves the right to remove any Content from the Service at any time, for any reason, and without notice.
